Please read these rules (the “Official Rules”) before entering this giveaway. By entering and participating in this giveaway, you agree to be bound by, and comply with, these Official Rules and confirm that you satisfy all of the eligibility requirements set out below. 1. GENERAL
This giveaway is operated by Rebellion Services Limited, a company registered in England and Wales with company number 11434613 and with its registered address at Riverside House, Osney Mead, Oxford, OX2 0ES, United Kingdom (“Rebellion”, “we”, “our”, “us”). The giveaway is void where prohibited or restricted.
2. ELIGIBILITY
2.1. To be eligible to enter the giveaway, entrants must:
2.1.1. be over 18 years of age at the time of entry;
2.1.2. have an internet connection and compatible device for entering the giveaway;
2.1.3. be resident in one of the following territories: (a) the United Kingdom; or (b) the following states of the United States of America: Alabama, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Oklahoma, Ohio, Oregon, South Carolina, South Dakota, Tennessee, Texas, Utah, Rhode Island, Vermont, Washington, Wisconsin, West Virginia; and
2.1.4. not be: (a) employees of Rebellion or its affiliates; (b) employees of agents or third parties who are directly associated with the giveaway or its administration; or (c) members of the immediate families or households of (a) or (b).
2.2. By entering this giveaway, you confirm that you are eligible to do so and eligible to claim any prize you may win.
2.3. Rebellion reserves the right to disqualify, refuse entry, or refuse to award the prize, to anyone in breach of these Official Rules or whose conduct is contrary to the spirit or intention of this giveaway.
3. HOW TO ENTER
3.1. NO PURCHASE NECESSARY. This giveaway is free to enter. As such, the purchase of any goods or services does not provide an advantage.
3.2. The giveaway will run from 2:00pm BST on Monday 20th July until 11:59pm BST on Sunday 2nd August (the “Entry Period”). Any entries received after the Entry Period will not be entered into the giveaway.
3.3. To enter, fill in the online entry form with your name and contact information. The entry form link will be sent via email to Rebellion Shop and 2000 AD newsletter subscribers. You must also comply with the terms and conditions of the Rebellion Shop.
3.4. Only one entry per person is permitted. Repeat entries from the same person will not be counted and persons submitting such repeat entries may be disqualified from the giveaway.
3.5. We will not accept incomplete entries, bulk entries or entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or other automated devices.
3.6. To the maximum extent permitted under applicable law, we accept no responsibility or liability for any entry which is unsuccessful, incomplete, lost, late, damaged, corrupted, misdirected or otherwise fails to be received, whether due to technical reasons, circumstances outside of our control, or any other reason.
4. PRIZE
4.1. The prize for this giveaway is a Limited Edition Online-Only T-Shirt from the Rebellion Shop worth £26.99 GBP. There is 1 prize available to be won. For US entrants, the verifiable retail value each t-shirt is USD $35.99.
4.2. The chances/odds of winning depend on the number of eligible entries received by Rebellion. The more people who enter the giveaway, the smaller your chances/odds of winning a prize.
4.3. The prize is non-exchangeable, non-transferable and there will be no cash alternative offered.
4.4. We reserve the right to substitute prizes with another prize of equal or higher value if circumstances beyond our control make it necessary to do so.
5. WINNER SELECTION
5.1. The winner will be selected randomly by Rebellion and notified via email within seven days of expiry of the Entry Period.
5.2. For physical prizes, the winner must provide a valid UK or US postal address to receive their prize. For digital prizes, the winner must provide a valid email address to receive their prize. For residents in Georgia, a telephone number is also required.
5.3. Rebellion will attempt to contact a winner a total number of three times via the contact method set out under clause 5.1. Be aware that Rebellion will be unable to contact winners if any security settings prevent Rebellion from doing so. If a winner: (a) does not respond within fourteen days of Rebellion’s third attempt to contact; (b) rejects the prize; (c) is ineligible or otherwise in breach of these Official Rules; (d) is unable to claim the prize for any other reason, the winner will lose their right to claim the prize, and Rebellion reserves the right to select another winner using the same process as described above.
5.4. The decision of Rebellion regarding any aspect of the giveaway is final and binding and no correspondence will be entered into regarding this.
6. RECEIVING THE PRIZE
6.1. The prize will be shipped to the winner from the UK. The winner is responsible for all taxes, duties, customs, fees and/or other expenses which are payable as a result of claiming the prize, where reasonable for all listed eligible territories, however Rebellion will cover the cost of shipping/postage (if any).
6.2. Rebellion does not accept responsibility if any required email or postal address is incomplete or inaccurate and, as a result, your prize is unsuccessfully delivered. Any prize that is returned undelivered will be deemed rejected and Rebellion reserves the right to randomly select another winner using the same process as described above.
6.3. For physical prizes, please allow at least up to 30 days from providing your valid UK or US postal address and (if applicable) telephone number for delivery of any physical prize (unless the right to win is withdrawn for any reason in accordance with these Official Rules), and please be aware that postal delays could impact the delivery of the prize.
6.4. For digital prizes, these will be awarded within 30 days following our notification that you are a winner (unless the right to win is withdrawn for any reason in accordance with these Official Rules)
7. DATA PROTECTION
7.1. For more information regarding how we store your data please click here to read our privacy policy. Our privacy policy sets out the types of personal data we collect and use when you use our products and services, and when you access and visit our websites and how we may use that data.
7.2. We must either publish or make available information to show that a valid award took place. Usually, this is the surname and county of the winner will be made available on request to those sending an email request to Reports@Rebellion.co.uk within one month after expiry of the Entry Period. If you object to any or all of your surname, county and winning entry being made available, please contact us at Reports@Rebellion.co.uk. Please note that Rebellion must still provide information on the winning entry to the UK Advertising Standards Authority (or other similar regulators) on request.
8. UNITED STATES RESIDENT-SPECIFIC TERMS
8.1. The following terms apply specifically to entrants who are residents of the United States.
8.2. LIABILITY RELEASE: UNITED STATES ENTRANTS, ON BEHALF OF THEMSELVES AND THEIR ASSIGNS, HEIRS, DEVISEES, AND ESTATE (COLLECTIVELY, “SUCCESSORS”), HEREBY UNCONDITIONALLY RELEASES, DISCHARGES, AGREES TO HOLD HARMLESS, AND COVENANTS NOT TO SUE: (i) REBELLION OR (ii) ANY OF REBELLION’S AFFILIATES, ALONG WITH EACH OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, AND CONTRACTORS (EACH A “RELEASED PARTY” AND COLLECTIVELY, THE “RELEASED PARTIES”), FROM ANY AND ALL CLAIMS, JUDGMENTS, COSTS, DAMAGES, LOSSES, EXPENSES, AND LIABILITIES (UNDER A THEORY OF CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE (WHETHER ACTIVE, PASSIVE, OR IMPUTED), STRICT LIABILITY, PRODUCT LIABILITY, OR ANY OTHER THEORY) RELATING TO ANY CLAIM ENTRANT MAY NOW OR HEREAFTER HAVE WITH RESPECT TO ANY DEATH, PERSONAL INJURY, PROPERTY DAMAGE, PECUNIARY LOSS OR OTHER LOSS, DAMAGE, COST, OR EXPENSE (COLLECTIVELY, “HARM”) THAT MAY BE SUFFERED BY ENTRANT OR ANY THIRD PARTY IN CONNECTION WITH PARTICIPATION IN THE PROMOTION, THE PRIZE, AND ANY USE BY REBELLION OF ENTRANT’S NAME, EMAIL ADDRESS, PHYSICAL ADDRESS OR OTHER DATA PROVIDED TO REBELLION BY ENTRANT, EVEN IF SUCH HARM IS CAUSED SOLELY BY THE RECKLESSNESS, NEGLIGENCE OR FAULT OF ONE OR MORE RELEASED PARTIES (COLLECTIVELY, THE “RELEASED CLAIMS”). EACH PARTY HEREBY IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THIS RELEASE OR ANY OF THE RELEASED CLAIMS.
8.2.1. IF ENTRANT IS A CALIFORNIA RESIDENT OR COULD OTHERWISE CLAIM THE PROTECTIONS OF CALIFORNIA LAW, ENTRANT FURTHER EXPRESSLY WAIVES THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE, WHICH READS AS FOLLOWS:
“A general release does not extend to the claims which the creditor does not know or suspect to exist in his favor at the time of executing the release which, if known by him, must have materially affected his settlement with the debtor.”
8.2.2. ENTRANT SPECIFICALLY UNDERSTANDS AND AGREES THAT THIS RELEASE WILL PREVENT ENTRANT AND ENTRANT’S SUCCESSORS FROM BRINGING A LAWSUIT OR OTHER ACTION AGAINST ANY RELEASED PARTY AND FROM RECOVERING MONEY DAMAGES OR OTHER LEGAL RELIEF FROM ANY RELEASED PARTY IN CONNECTION WITH ANY OF THE CLAIMS RELEASED ABOVE.
8.2.3. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
9. MISCELLANEOUS
9.1. Rebellion reserves the right to:
9.1.1. verify the eligibility of any entrant;
9.1.2. disqualify any entrant found to be abusing or tampering with the operation of the giveaway or entering using fraudulent or unlawful means; and
9.1.3. disqualify any entrant who posts an entry on Rebellion’s social media account which is, in the Rebellion’s reasonable opinion, inappropriate, offensive, reputationally damaging or contrary to applicable law (and to require the entrant to remove such post).
9.2. Rebellion reserves the right to extend, withdraw, alter or suspend the giveaway or to amend these Official Rules at any time if circumstances beyond its control make this unavoidable.
9.3. You agree that Rebellion may, but is not required to, make some or all of the contents of your entry available on its website, social media accounts or any other media, including in connection with any publicity of the giveaway. You will retain ownership of any copyright subsisting in your entry. By entering the giveaway, you hereby grant to Rebellion a non-exclusive, worldwide, royalty-free, fully paid up, irrevocable licence, for the full period of any intellectual property rights in your entry and any accompanying materials to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the contents of that entry and any accompanying materials for such purposes.
9.4. You unconditionally and irrevocably waive any moral rights in relation to your entry to which you may now or at any future time be entitled and this waiver is in favour of Rebellion.
9.5. If requested to do so by Rebellion, you shall execute all documents and do all such acts as may be required to give effect to the above waiver or licence.
9.6. Rebellion shall not be liable to any entrant for: (a) any failure to comply with these Official Rules as a consequence of events beyond its reasonable control including, without limitation, any failure of communication networks as a consequence of any circumstances beyond the reasonable control of Rebellion; and/or (b) any loss of profits, loss of revenue, loss of business opportunity or business interruption.
9.7. Save as set out in clause 9.6, if Rebellion fails to comply with these Official Rules, it will be responsible for loss or damage entrants suffer that is a foreseeable result of Rebellion’s breach of these Official Rules. Rebellion is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of Rebellion’s breach or if it was contemplated by you and Rebellion at the time these Official Rules became binding.
9.8. Rebellion will not be obliged to provide any form of practical or IT support in respect of the prize.
9.9. Notice for residents of Texas: Buying Will Not Help You Win. Your chances of winning without making a purchase are the same as the chances of someone who purchases something. It is illegal to give any advantage to buyers in a sweepstakes.
9.10. The giveaway is not in any way sponsored, endorsed or administered by, or associated with X, Instagram, Facebook, or any other third party referred to in the giveaway. Entrants acknowledge that those persons shall not have any liability to entrants in connection with the giveaway.
9.11. Each of the clauses of these Official Rules operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.
9.12. The giveaway and these Official Rules are governed by English law. This means that your entry into the giveaway, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims) will be governed by English law.
9.13. You may bring any dispute which may arise under these Official Rules, at your discretion, either the competent court of England, or to the competent court of your country of habitual residence if this country is within the UK, which courts are competent to settle any such a dispute. Rebellion will bring any dispute which may arise under these Official Rules to the competent court of your country of habitual residence if this is within the UK or otherwise the competent court of England.
